An employer is not required to pay an employee the compensation described in ORS 653.442 or 653.455 when the employee is covered by a collective bargaining agreement or other collectively-bargained contract that is in force at the employee’s work site and that provides the employee a remedy equal to or better than the remedy provided by ORS 653.442 or 653.455.
