OAR 837-039-0060: Nonexempt Jurisdictions

(1) Local government subdivisions who have not applied for and been granted exempt status by the State Fire Marshal operate fire code administration programs in conformance with this division. (2) Under ORS 476.060, public fire marshals and fire chiefs are designated as Assistants to the State Fire Marshal and enforce the fire code in conformance with this division. (3) There are two areas of nonexempt enforcement activities: (a) Responses to imminent life or property threats; and (b) Inspection and enforcement of the state fire code.
