OAR 438-085-0250: Requests for Mediation

(1) The parties shall notify the assigned Administrative Law Judge of their desire to mediate their controversy. The parties may select a mediator from an approved list provided by the Hearings Division. If the parties do not indicate a choice of mediator or cannot agree, a mediator may be selected by the assigned Administrative Law Judge. (2) Persons who are not parties to a mediation may be included in mediation discussions with the consent of the mediator and the parties.
