Edition: 2026Effective: UnknownLast verified: 2026-09-07
Once an Accusatory Instrument is filed in the form of an Information of Misdemeanor, Contempt or Violation, it cannot be amended or replaced with an Indictment as a new Accusatory Instrument, without the prior Accusatory Instrument being dismissed. Court staff will reject an Indictment filed wrongly in a case with an Information other than an Information of Felony, or direct its filing into a new case and set it with the existing case for Arraignment.
