Trial by affidavit or declaration, as provided in ORS 153.080 is authorized for all violations. If Page 35 of 37 the defendant chooses to waive the right to have testimony presented orally in court or waive the right to a hearing in court, the defendant must make this request by completing a signed written waiver and filing it with the court. A sample form may be obtained by contacting the court.
