SLR 14-8.135: DISMISSAL OF RESTRAINING ORDERS (FAMILY ABUSE PREVENTION ACT)

ACT) (1) Petitioners seeking a dismissal of a restraining order under the Family Abuse Prevention Act (FAPA) must: (a) File a motion that complies with ORS 107.720(2); (b) Provide a certificate of completion of a court -approved “Abuse Awareness” course. (2) A list of court -approved “Abuse Awareness” course providers is available in person at the family court service window and on the court February 1, 2026 14th Judicial District – Josephine County Circuit Court -21- website defined in SLR 1.171 under Protective Orders, Abuse Awareness Course Information. (3) Upon a showing of good cause, a petitioner may request waiver of the attendance requirement of this program. The request must be made by written motion, supported by declaration / affidavit, and filed with the court. (4) Upon filing of the motion to dismiss restraining order, the party requesting dismissal will be scheduled in for hearing before the Family Court Judge.
