OAR 859-200-0105: Standards and Burdens of Proof

(1) The standard of proof on all issues at all hearings of the Board under Division 200 shall be preponderance of the evidence. (2) The State always has the burden of proof for all PSRB hearings and the State has the burden of going forward with the evidence.
