(1) Purpose. These rules establish the amount of earned income the Division excludes when calculating ability-to-pay for cost of care at a mental health institution. The purpose of this earned income exclusion is to reduce the disincentive to work for patients and residents. (2) Statutory Authority. These rules are authorized by ORS 413.042 and carry out the provisions of ORS 179.770.
