(1) CRIME CATEGORY 5: Theft by Receiving shall be ranked at Crime Category 5 if the offender was acting as part of an organized fencing operation. (2) CRIME CATEGORY 3: Theft by Receiving shall be ranked at Crime Category 3 if it cannot be ranked at Crime Category 5.
